Welcome to Icynap. The terms "we", "us" and "our" refer to Icynap. Icynap operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Icynap is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers, limitations of liability, shipping responsibilities, customs charges, and dispute resolution.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Section 1 - Australian Consumer Law
If you are a consumer within the meaning of the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our goods and services come with guarantees that cannot be excluded. Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law that cannot be lawfully excluded or limited.
For major failures with the goods, you are entitled to a replacement or refund and compensation for any other reasonably foreseeable loss or damage. For minor failures, you are entitled to have the goods repaired or replaced.
To the extent that any provision of these Terms is inconsistent with the Australian Consumer Law, that provision shall be read down or severed to the extent of the inconsistency.
Section 2 - Access and Account
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
Section 3 - Our Products
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colours, dimensions, packaging, or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance, packaging, or quality of any products or services purchased by you will meet your expectations or be exactly the same as depicted or rendered in our online stores, except to the extent required by the Australian Consumer Law.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
All products sold by Icynap are non-medical consumer products intended solely for general pet comfort, convenience, support, or everyday use. They are not medical devices, veterinary devices, safety equipment, or protective products and must not be relied upon to diagnose, treat, prevent, monitor, or cure any medical condition, illness, injury, or environmental hazard.
Cooling, comfort, travel, support, and pest-related products offered by Icynap are designed to support general pet comfort only. They do not guarantee prevention of overheating, heat stress, heatstroke, injury, parasite exposure, fleas, ticks, or any other health-related condition. These products must not be relied upon as the sole method of cooling, supervision, protection, or parasite prevention.
Use of any Icynap product does not replace professional veterinary advice, diagnosis, treatment, medication, supervision, hydration, shade, ventilation, environmental management, or preventative care. Responsible pet care remains the sole responsibility of the pet owner.
Pet owners acknowledge that the safety, suitability, and effectiveness of any product depends on factors such as proper use, supervision, environmental conditions, fit, storage, maintenance, and the health and behaviour of the animal. Individual outcomes will vary and are not guaranteed.
Icynap products are designed for pets and their owners and are intended to provide comfort, support, and enrichment only. All products must be used responsibly and under appropriate supervision. Icynap is not responsible for misuse, improper use, abuse, chewing, ingestion, destruction, pet damage, or any damage caused by pets while using our products, except to the extent that liability cannot be excluded under the Australian Consumer Law.
Section 4 - Orders
When you place an order, you are making an offer to purchase. Icynap reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Icynap confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting, as Icynap may be unable to accommodate cancellation requests after an order is accepted.
In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
We reserve the right to refuse, cancel, or limit any order for fraud prevention, pricing errors, suspected misuse, inventory limitations, suspected resale activity, shipping restrictions, or compliance reasons.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy and your rights under the Australian Consumer Law.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Section 5 - Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
Prices displayed on the Services are shown in the currency indicated at checkout. Unless otherwise expressly stated, posted prices do not include customs duties, import charges, clearance fees, or similar charges that may be imposed by Australian authorities on imported goods. GST may be collected at the point of sale in accordance with Australian tax law for low-value imported goods.
Depending on your location and payment method, banks, card issuers, payment providers, or financial institutions may apply international transaction fees, currency conversion fees, processing charges, or similar charges. These charges are imposed by the relevant provider, not by Icynap, and are not controlled, collected, or refunded by Icynap.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card or other payment information you provide is true, correct, and complete, (ii) you are duly authorised to use such payment method for the purchase, (iii) charges incurred by you will be honoured by your payment provider, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, duties, or fees, if any.
Section 6 - Shipping and Delivery
All delivery times are estimates only and are not guaranteed. We are not liable for shipping or delivery delays caused by shipping carriers, customs processing, supply chain disruptions, severe weather, labour disruptions, force majeure events, or other events outside our reasonable control.
Orders may be fulfilled and shipped from international fulfilment centres depending on stock availability, destination, and logistics requirements.
Unless otherwise expressly stated, posted prices do not include import duties, customs charges, clearance fees, or similar charges imposed by the destination country. These charges are not included in the product price or shipping fee and are the sole responsibility of the customer, except where GST has been collected at the point of sale in accordance with Australian tax law.
Once we transfer products to the carrier, title and risk of loss passes to you to the fullest extent permitted by the Australian Consumer Law.
Orders that are refused, unclaimed, abandoned, returned, destroyed, delayed, or otherwise not delivered due to incorrect address information supplied by the customer, failure to pay customs or import charges, or failure to collect the package may not be eligible for a refund, reshipment, or replacement, except where required by the Australian Consumer Law.
Section 7 - Intellectual Property
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Icynap, its affiliates or licensors and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.
Icynap's names, logos, product and service names, designs, and slogans are trademarks of Icynap or its affiliates or licensors. You must not use such trademarks without the prior written permission of Icynap. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
Section 8 - Optional Tools
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools, except to the extent that liability cannot be excluded under the Australian Consumer Law.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
Section 9 - Third-Party Links
The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third-party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction.
Section 10 - Relationship with Shopify
Icynap is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Icynap. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Icynap, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Icynap, except to the extent that such release is prohibited under the Australian Consumer Law.
Section 11 - Privacy Policy
All personal information we collect through the Services is subject to our Privacy Policy and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Section 12 - Feedback
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use.
You represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third-party.
Section 13 - Errors, Inaccuracies and Omissions
Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.
Section 14 - Prohibited Uses
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any applicable law, regulation, or ordinance; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services.
In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the Services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools, agentic AI, or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorisation features of the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
Section 15 - Termination
We may terminate this agreement or your access to the Services, or any part thereof, in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Australian Consumer Law, Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Dispute Resolution, Privacy Policy, and any other provisions that by their nature should survive termination.
Section 16 - Disclaimer of Warranties
The information presented on or through the Services is provided for general informational purposes only. We do not guarantee that any information available through the Services is accurate, complete, or up to date. Any reliance you place on such information is at your own risk.
Subject to the Australian Consumer Law, all Services and products are provided on an "as is" and "as available" basis, without any representations, warranties, or conditions of any kind, whether express, implied, statutory, or otherwise.
To the fullest extent permitted by applicable law (but subject to the Australian Consumer Law), Icynap disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified.
Section 17 - Limitation of Liability
To the fullest extent permitted by the Australian Consumer Law and any other applicable law, Icynap, including its directors, officers, employees, affiliates, agents, contractors, suppliers, and service providers, shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
This includes, without limitation, loss of profits, revenue, savings, data, goodwill, or business interruption arising out of or related to your use of the Services or any products purchased through the Services.
Without limiting the foregoing, Icynap shall not be liable for any injury, illness, damage, or loss resulting from product use, misuse, improper use, lack of supervision, environmental conditions, or reliance on any product as a substitute for veterinary care, medical treatment, or preventative measures.
Where the Australian Consumer Law applies and liability cannot be excluded, Icynap's liability is limited, at its option, to:
- In the case of goods: the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or acquiring equivalent goods; or the payment of the cost of having the goods repaired.
- In the case of services: the supplying of the services again; or the payment of the cost of having the services supplied again.
To the maximum extent otherwise permitted by law, Icynap's total liability for any claim arising out of or relating to the Services or any product purchased shall not exceed the amount paid by you for the product giving rise to the claim.
Section 18 - Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Icynap, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- your breach of these Terms
- your violation of any law or regulation
- your misuse of the Services or products
- your infringement of any third-party rights
We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you. This section does not apply to the extent that it would require you to indemnify Icynap in respect of a consumer guarantee right under the Australian Consumer Law.
Section 19 - Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain valid and enforceable.
Section 20 - Waiver and Entire Agreement
These Terms of Service, together with any policies referenced herein, constitute the entire agreement between you and Icynap and govern your use of the Services.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Section 21 - Assignment
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms and our rights and obligations at any time without notice.
Section 22 - Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, and the Commonwealth of Australia, without regard to conflict of law principles. You and Icynap consent to the non-exclusive jurisdiction of the courts of New South Wales, Australia, and any courts which may hear appeals from those courts.
Nothing in this section limits your rights to bring proceedings in any court of competent jurisdiction, including under the Australian Consumer Law.
Section 23 - Dispute Resolution
If a dispute arises out of or relates to these Terms or the Services, the parties agree to first attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved within 30 days of written notice from one party to the other, either party may pursue resolution through the courts of New South Wales, Australia, or through any applicable tribunal or consumer protection authority, including the Australian Competition and Consumer Commission (ACCC) or the relevant state or territory fair trading body.
Nothing in this section prevents you from making a complaint to the ACCC, a state or territory consumer protection agency, or seeking urgent injunctive relief from a court of competent jurisdiction.
Section 24 - Changes to Terms of Service
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page and will take effect upon posting.
Your continued use of the Services following any updates constitutes acceptance of those changes. Any changes apply to future transactions only and do not affect your existing rights under the Australian Consumer Law.
